MISSION/CORE PURPOSE:

The Manager, Legal and Regulatory is responsible for the in-house management of all legal and Regulatory matters in coordination with Lonestar Cell MTN the which includes:

  • Provide timely and accurate counsel to the company.
  • Perform, coordinate, evaluate and provide legal services to all divisions within Lonestar Cell MTN
  • Collaborate with management to devise efficient defense strategies.
  • Specify internal governance policies and regularly monitor compliance.
  • Mitigate any aspect of legal risks and align Lonestar Cell MTN operations with best judiciary practices.
  • Ensure that the necessary compliance monitoring is in place after the laws and regulations have been implemented.
  • Ensure all regulatory compliance across all internal business functions and processes are strictly adhere to
  • Provide regulatory guidance and support on various business issues.
  • Make the necessary input into regulatory policies/regulations to ensure compliance, legislative framework and future impact of new and pending regulatory policies and legislations on Lonestar Cell MTN operation is aligned with best practices.

 

CORE RESPONSIBILITIES:

Key Performance Areas:

  • Research and evaluate different risk factors regarding business decisions and operations.
  • Track and close all labour issues and liaise with the concerned function to address identified labour issues related to company business.
  • Apply effective risk management techniques and offer proactive advice on possible legal issues.
  • Communicate and negotiate with external parties (regulators, external counsels, public authorities, etc.), creating relations of trust.
  • Represent the company in all Corporate Governance Subcommittees’ meetings to ensure alignment with other operators and report accordingly.
  • Assist in providing legal advice to functional divisions and continuously provide awareness of applicable legal practices in their respective areas, when required.
  • Draft and solidify agreements, contracts and other legal documents to ensure the Company’s full Legal Rights.
  • Develop and maintain processes and procedures necessary for the job.
  • Deal with complex matters with multiple stakeholders and forces
  • Track all legal correspondences for possible litigations and dispute resolution.
  • Provide clarification on legal language or specifications to everyone in the organization.
  • Conduct your work with integrity and responsibility and build Lonestar Cell MTN’s profile positively amongst government stakeholders.
  • Maintain current knowledge of alterations in legislation.
  • Perform Ad-Hoc duties as assigned by management.
  • Track aspects of compliance in line with legislative obligations binding on Lonestar Cell MTN

Supervisory /Managerial/ Leadership Complexity:

  • Management of the legal affairs requires high level of knowledge of the sector particular drivers, different objectives that can be contradicting, and associated complexities and political and social sensitivities.
  • Ensuring legal compliance while protecting company rights, trademarks and registration requires high level of care and wisdom and strong negotiations and influential skills.

Role Complexity

  • It is very important for the person in this role to have a fair understanding of objectives and nature of the operations in the various technical and commercial functions to and be able to effectively provide reliable Legal and Regulatory advice and guidance.

  • Use an innovative approach to problems, implementing within in time, cost and quality.
  • Proposing regarding regulatory risk resolution in the implementation phase.
  • Creation of business solutions and responses to regulatory risks and issues.
  • Innovation with regards to the implementation of laws and regulations (within the deadlines set).
  • Enhancing and defining processes to further improve the implementation of laws and regulations.
  • Applying an understanding of which areas of the business need to be included when implementing laws and regulations.
  • Negotiation with external/third parties such as other mobile operators and regulators to design innovative solutions for implementation of laws and regulations.
  • Regulatory issues and dispute matters require that the incumbent propose and pursue creative solutions and decision.

Independent thought and Judgment:

  • Use of independent thought and judgement in the implementation of laws and regulations with input from regulatory advisors.
  • Development of the business solution to ensure compliance, with actual solution to be approved by the various stakeholders.
  • Changes in processes with regards to implementation of laws and regulations.
  • Which business units to include in the implementation of laws and regulations.
  • Use of best practices to ensure regulatory compliance.
  • Knowledge of Project Management Principles and practices

 

QUALIFICATION AND EXPERIENCE:

Education

  • Bachelor’s degree in law
  • Degree in Telecoms Regulations/Telecoms Costs or Interconnect Management is advantageous.
  • Must be an Attorney/Counsellor at Law. An active member of the Liberia National Bar Association and must present an active license during application.

Global Experience Standards

  • Minimum of three (3) years’ working experience, with proven track record, in a telecoms policies and legislations industry
  • Minimum of three (3) years’ demonstrated experience in managing relations with government and other relevant industries
  • Excellent skills in legislative negotiation with demonstrated experience in building a legislative network and managing expectations.
  • Strong experience in negotiating deals and concluding contracts.
  • Demonstrated commitment to getting the job done.
  • Worked across diverse cultures and geographies advantageous.
  • In depth knowledge and experience with the laws of Liberia in particular contract, labor, transaction and corporate law.

  • Ability to write comprehensive reports and communicate with all levels of Management within Lonestar Cell MTN.
  • Proficient with Microsoft office suite, with special skill in using PowerPoint, Word and Excel
